If a Nevada Constable receives a payment for a lien that has been stayed, they will return the payment to ADP and we, in turn, will return the funds to the employer. Garnishees should begin withholding for Nevada writs of garnishment that are still in effect (have not exceeding their withholding timeframe). Child Support Payments will continue to be processed and disbursed during this time. ADP confirmed with DOR that the agency will not be issuing any new wage levies until further notice.

Tax Debts – The second largest reason for wage garnishments, according to ADP, is tax debt. Reading up on your state’s laws about processing fees or reimbursement and contacting your payroll partners are good moves when first receiving a wage garnishment notice. The Agency does not anticipate a delay in the processing of any child support payments received due to the coronavirus. There are cases, however, where wage garnishments can claim even more of an employee’s paycheck, such as in the case of child support, when up to 50 percent of disposable income can be taken. Bank garnishments are stayed until June 17, 2020 to protect CARES Act stimulus payments as well as state and federal unemployment payments, from bank garnishments.

On March 18, 2020, the state of Georgia issued a state of emergency order prohibiting the filing of new writ of garnishments. During the public health emergency and for 60 days after its conclusion, no creditor or debt collector will initiate new garnishments. We have an online payment service called iPayOnline in which individuals can make payments without having to drive to an office and make a physical payment.
In other words, only a portion of an employee’s paycheck can be applied to wage garnishments. But understanding the process and knowing what you can (and can’t) do in response to a garnishment notice might be difficult for an employer who has never handled one before.
